Wireless Terms and Conditions

The subscriber agrees to the following terms and conditions: 

A. Payment of bills
The subscriber will be fully responsible for the payment of all charges, which begin upon the date of arrival of the wireless equipment. All payments are due by the 25th of each month and become past due if not received by this date. If subscriber does not receive notice of an online invoice by the 15th of each month, it is the subscriber's responsibility to notify OIT. If services are suspended due to lack of payment, all past due and current charges, including non-payment processing fees, must be paid before service can be reinstated. Subscriber is subject to a $15.00 charge if services are suspended for non-payment. If subscriber's account remains unpaid, a hold may be placed on the subscriber's university records and registration.

All new wireless service requests must be approved by an employee's department before they can be processed. It is the responsibility of the individual(s) placing the order to get prior approval with their departments. Please ensure that your department's business manager has authorized the request prior to submitting any cellular requests.

B. Disconnection of services
Subscriber must contact OIT to discontinue services no later than 3 business days prior to the end of the month. Requests received later than that may not be completed by the vendor until the next billing cycle. All services are discontinued at the end of each month. Please see Section K, Breach of Contract, for information on early termination fees.

C. Additional Lines
Individual subscribers can have a maximum of two lines.

D. Billing errors
Subscriber must contact OIT to report billing errors, in order to receive appropriate credit.

E. Toll Free Mobile Phone Calls
Toll Free are not air time free.  Toll Free calls made on the subscribers wireless phone between the hours of 6:00 AM and 8:59 PM on Weekdays, will count against the subscribers package Minutes. If the subscriber's package minutes are exhausted, the user will be charged the appropriate overage fee per minute. Click here for other important mobile phone calls that are not air time free.

F. Online billing and payment
Subscriber's electronic payments are posted to accounts within 24-48 hours. Payments are reflected on the next invoice. If subscriber has paid the balance forward on the bill, but it is not yet reflected on the bill, subscriber should deduct it from the total amount due when paying the bill. Subscriber may cancel enrollment in the online service at any time by contacting OIT. The next billing statement after this request will be mailed via U.S. Mail.

G. Equipment Pickup Policy
Wireless phone and accessories will be returned to vendor 5 business days after subscriber has been notified of arrival, which may result in termination of contract.

H. Rates and rate changes
Rates for wireless services are available here. Rates will be established each August and remain in effect for one calendar year. International rates are subject to change when new international tariffs are approved and implemented by the vendors providing wireless service to the university. At least 30 days notice will be given prior to any rate increase. If OIT receives less than thirty days notice of a rate increase, notice shall be given as soon as possible.

I. Additional Fees
The following fees will be assessed to the subscriber's account: $25.00 for the reconnection of service which was terminated due to non-payment; $25.00 per returned check; $15.00 charge if services are suspended due to non-payment. The North Carolina Utilities Commission does not regulate rates, charges, payment arrangements, and rules on disconnection.

J. Emergency service
Enhanced 911 emergency service (E911), which permits automatic identification of the caller and the caller's location, is available through the university's telephone system. Persons calling 911 from the university should provide their identification and location to the 911 operator. Such calls must be completed by dialing 911 from the university telephones.

K. Breach of contract
This contract shall be voidable at the option of the subscriber and without further liability to the subscriber if OIT breaches the contract. This contract may be terminated by OIT upon the subscriber's breach of contract. Subscriber will be liable for all charges incurred up to the date of breach. Verizon subscribers who breach contract by terminating services within one calendar year will be subject to a $175.00 cancellation Fee. Alltel data devices are subject to a one calendar year commitment. Cancelling service on an Alltel data device prior to the end of one calendar year will result in a $200 early termination fee.

L. Governing Rules and Regulations
A copy of Chapter 14A of the Rules and Regulations of the North Carolina Utilities Commission is available for inspection upon request. A copy of this Chapter will be provided free of charge upon request by the subscriber. Please direct all requests to wireless-info@duke.edu

M. Theft and Fraud
If your Service or Equipment is lost or stolen or fraudulently used, then you are responsible for all usage incurred before we receive notice from you of such loss or theft. You agree to cooperate in the investigation of fraud or theft and to provide us with such information and documentation as we may request (including affidavits and police reports).  More information on replacing a lost or stolen phone is available in our FAQ.

N. Return Policy
Subscribers are bound be the terms of the Duke University Wireless Device Return Policy.

O. Restrictions on Upgrades
Vendors govern the ability to upgrade service or equipment.  Upgrades are generally allowed only after completing one calendar year of service.  Upgrades can be requested prior to that period, but you may be assessed the full retail cost of the device.  See the "Breach of Contract" section for details on possible fees.
In addition, upgrading service requires that you begin a new one calendar year service period.  The vendors disallow new equipment without a new contract, even if you wish to pay the full retail price for the equipment.

P. Taxes
You will be assessed State, Local, and Federal taxes on every invoice that you are billed for service.
